These Terms of Service (“Terms”) set out the basis on which Aspen Tree Surgery Ltd (“we”, “us”, or “our”) provides arboricultural and related services to customers (“you”, “your”). By engaging our services, you agree to these Terms.

1. Quotations & Estimates

• All written quotations/estimates are valid for 30 days unless otherwise stated.

• Quotations are based on the information available at the time of inspection. Any unforeseen circumstances (e.g. hidden obstacles, decay, additional work required) may result in revised costs.

2. Scheduling & Access

• We will agree a mutually convenient date for works.

• You must ensure we have clear and safe access to the work site, including vehicle access for equipment, unless otherwise agreed.

• If access is not possible, additional charges may apply.

3. Tree Ownership & Permissions

• It is your responsibility to confirm ownership of trees and obtain any necessary consents (e.g. Tree Preservation Orders (TPOs), Conservation Area approvals, neighbour permissions).

• We can assist with TPO/conservation checks, but ultimate responsibility remains with you.

4. Site Conditions & Safety

• We take all reasonable care to minimise disturbance, but tree work is hazardous by nature. While precautions are taken, we are not liable for minor damage to lawns, garden surfaces, or plants unless specifically agreed.

• Large timber/branches will be left on site unless removal is included in the quotation.

5. Waste Removal

• Quotations will state whether waste is to be removed, left in manageable sections, or chipped on site.

• Any additional disposal requests may incur extra charges.

6. Payment Terms

• Invoices are due for payment within 7 days of completion unless otherwise agreed.

• We reserve the right to charge interest and/or administration fees on late payments in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

• All goods and services remain the property of Aspen Tree Surgery Ltd until paid in full.

7. Insurance & Liability

• We hold full Public Liability Insurance and Employers’ Liability Insurance, details available on request.

• We will carry out works to industry standards (BS3998: Recommendations for Tree Work) where applicable.

• We are not liable for:

  • Pre-existing structural weaknesses, decay, or disease in trees.

  • Damage caused by circumstances beyond our control (e.g. severe weather during or after works).

8. Cancellations & Postponements

• Cancellations must be made at least 48 hours before scheduled work.

• Late cancellations may incur charges to cover costs already incurred (labour scheduling, equipment hire, etc.).

• We reserve the right to postpone works for safety reasons (e.g. high winds, dangerous site conditions).

9. Complaints & Disputes

• Any complaints must be raised in writing within 7 days of completion of works.

• We will make every effort to resolve issues promptly and fairly.

10. Governing Law

• These Terms are governed by the laws of England and Wales.

• Any disputes will be subject to the jurisdiction of the courts of England and Wales.
